Draft amendment of the Act on supporting the development of telecommunications networks and services, prepared by the Ministry of digitization, also has to implement the provisions of Directive 2014/61 / EU on measures aimed at reducing the costs of high-speed electronic communications networks. According to the authors of the elimination of barriers to investment and reduce the cost of construction of broadband networks will be possible through more intensive use the existing technical infrastructure, better cooperation in planning and engineering works and construction and the removal of barriers to access telecommunications companies to buildings and infrastructure in buildings.

The new regulations, ensuring the simplification and acceleration of the investment process, to facilitate the construction of broadband networks, including those implemented under the Operational Programme Digital Poland. The funds from this program could amount to more than 1 billion euros. According to the initiators of the amendment, this aid should go primarily to telecommunications companies to support the construction, extension or reconstruction of telecommunications networks that provide broadband Internet bandwidth of 30 Mb / s and higher. It provides for the legal solutions that telecom operators will facilitate the implementation of the investments necessary for the organization of World Youth Day.

How can justify the resort digitization, without amending the legislation will be difficult to achieve the objectives adopted in the National Broadband Plan and the European Digital Agenda (EAC). The project also provides for extending the circle of entities administering technical infrastructure required to provide the telecommunications companies, who will use it to build a high-speed telecommunications networks. It is also proposed to introduce compulsory disclosure part of the data collected as part of the inventory carried out annually by the President of the Office of Electronic Communications. This includes Data on the entity holding facilities or services access to broadband Internet in your area and information about that location.

It also includes the creation of a separate Information Point for the Telecommunications (PIT), led by the President of the Office of Electronic Communications. The task of the PIT will be providing, among others, information on procedures and formalities in telecommunications investment process, information about the investment plans and the existing technical infrastructure. Access to this information will be via the website, and their collection will be in the database in the IT system. Sharing data with PIT will be free.

Also proposed is the introduction of the obligation for, among others, multifamily residential building or a public building in the telecommunications installation, if it is not in her features, and is subjected to reconstruction, the superstructure or expansion.

According to the new legislation the president of UKE would determine in the decision, so-called. framework for access to the property in order to provide telecommunications and placed on the facilities and equipment of the telecommunications infrastructure. These decisions would be binding on the forest districts, managers of closed areas, the owners (managers) of at least 10 multi-family buildings (in terms of co-operatives or community housing).

According to the authors of the project, these changes will affect the acceleration of negotiations with these entities and to reduce the cost of the agreements for access to the property.

Draft amendment also provides for the co-ordination of works. Telecommunication entrepreneur could build a high speed communication network at the same time and in the same place as the other party realizing their investment from public funds. Also introduced the obligation to inform, at the request of the company, planned within six months of construction works financed from public funds.

There will also be other changes in legislation: Shortening the deadline for a decision on the location of the lane telecommunications infrastructure from 65 to 45 days and the introduction of new rules expense ratio telecommunications infrastructure, if the road is subject to reconstruction or renovation, and not They passed four years from the date of the decision on the location. The amendment would introduce an obligation to carry out, on a reasoned request of local government units, control in the field of electromagnetic fields emitted from the installation of radio communication, radio navigation or radar. It also provides the ability to start using the radio installation when submitting the environmental protection authority, if the documentation provided confirms maintaining levels of electromagnetic fields below acceptable levels.
